Service Provider: Carlos Eli Escobar Ruiz, natural person, doing business as WebLabor ("Weblabor"), RFC EORC9302022E9, with address at Calle 19 #135 corner 32, Colonia Chuburná de Hidalgo, Mérida, Yucatán, Mexico.
Services:
- Hosting: hosting for the system that Weblabor develops with the Client, operated by the Weblabor team.
- Domain Management: support for managing and configuring the Client's system domains and connecting them with their hosting.
Related Documents: the quote or accepted written agreement, these conditions and the Weblabor General Terms and Conditions.
1. Object and nature of the services
Hosting is a hosting service in which the Weblabor team maintains online the system developed for the Client on servers of external providers. Domain management is a support service to register, configure and connect the Client's domains with that hosting.
These are services that are quoted. Their scope, conditions and cost, including those of any additional work such as domain transfers or delivery of information copies, are those of the quote. These conditions do not set prices.
2. Order of Precedence
If two documents contradict each other, they are applied in this order:
- The quotation or written agreement that the Client accepted, regarding what it expressly regulates.
- These conditions.
- Weblabor General Terms and Conditions.
What a document does not regulate is governed by the following.
3. What is included in hosting
Hosting includes what the quote specifies. According to the system, it may comprise the application hosting, its database, the security certificate (SSL), file storage, system email sending, and the publication of new versions.
Server resources (capacity, storage, traffic) are those indicated in the quote or reasonable for normal system usage. Systems may share infrastructure with others. A dedicated or isolated server is offered only if the quote states so.
What the quote does not include, such as personal email accounts, additional backups, migrations, or special adjustments, will be quoted separately.
4. Solo hosting for the Weblabor system
This hosting is for the system that Weblabor developed with the Client. Hosting other systems requires a separate agreement.
5. External Providers
To provide the service, Weblabor uses external infrastructure and services providers, such as server and deployment panel providers, DNS providers, file storage providers, email providers, and domain registrars. Each provider has its own terms, and Weblabor may change providers without this modifying the contracted service.
Weblabor does not control the decisions, failures, price changes, or interruptions of those providers. A provider failure is not, by itself, a breach of Weblabor. Weblabor does not promise a specific server location, specific encryption, or certifications.
6. Availability and maintenance
Weblabor makes reasonable efforts to maintain the system online, but does not guarantee an availability percentage, a maximum response time for outages, or uninterrupted operation.
There may be interruptions due to maintenance, updates, provider failures, attacks, excessive resource usage, or causes beyond your control. Weblabor strives to notify scheduled maintenance that may affect the service.
Attention is provided through official channels and during the hours established in the General Terms and Conditions. Those requiring guaranteed availability, monitoring, on-call support, or response times must contract a service level expressly defined in their quotation.
7. Backups
The hosting does not include automatic backups or their restoration, unless the quote includes them. The Client is responsible for having their own backups of the information they need to keep.
If the quote includes backups, it indicates their frequency, retention time and restoration cost. Weblabor does not guarantee recovery of information lost due to causes not attributable to it.
8. Acceptable use
The Client agrees to use the hosting in a lawful manner. It is prohibited to host or distribute illegal content, malicious software, spam or fraud, attack or compromise systems, and use resources abusively in a way that affects other systems.
Weblabor may limit or suspend the site, notifying when possible, if there is unlawful use or if it puts at risk the security or stability of the server or other systems.
9. Customer Responsibility for Their System
The Client is responsible for the content, data, and users of their system, and for complying with applicable laws. They must protect their access credentials and notify of any unauthorized use.
10. Domain Management: what it includes
Domain management may include, according to the quote: support for choosing and purchasing a domain, configuring its DNS, connecting it with hosting, and renewing it.
If the Client already has a domain, they can keep it with their provider and Weblabor will connect it to the hosting by configuring the necessary records, or they can delegate their DNS to Weblabor. The Client must provide the access or make the changes that Weblabor indicates.
Weblabor does not guarantee that a domain name is available or that it will be accepted by the registrar.
11. Domain Ownership and Administration
Domains are purchased in the Client's name. For this, the Client provides Weblabor with the holder information required by the registrar, and is responsible for ensuring it is accurate.
Weblabor administers the domain on behalf of the Client: it configures it, connects it, and renews it, according to the quote.
If the Client wants to manage the domain on their own, they can ask Weblabor to transfer it to their own account with the registrar of their choice; the transfer timelines depend on the registrar.
If the Client only wants to control the DNS records, Weblabor can give them access to DNS in Cloudflare. Weblabor does not provide the username and password of your account with your domain provider; anyone who wants to manage the domain there must transfer it to their account.
12. Renewals and payments
Hosting and domains are paid for in periods, normally each year, in advance, for the amount and payment method stated in the quote. They are separate services, with renewals and payments that can be different.
Weblabor notifies the Client before a service expires, through official channels. The lack or delay of a notice does not extend the expiration date or exempt from payment. Weblabor does not make automatic charges or renew a service without payment being received.
A payment counts as completed when Weblabor confirms that it has received the funds, as established in the General Terms and Conditions. Domain registration and renewal costs are charged by the registrar and are not refunded once made.
13. Lack of Payment
Hosting. If the hosting expires and is not renewed, the site may be suspended from the day after expiration. While suspended, the system is not available to your users. The Client has fifteen calendar days from the expiration date to pay; upon receiving payment, Weblabor reactivates the site. After those fifteen days without payment, Weblabor may remove the site and is not obligated to preserve it or restore it.
Domain. If a domain expires without being renewed, it is the registrar who blocks or withdraws it, not Weblabor, and it cannot always be recovered. Weblabor is not responsible for losing a domain due to failure to renew it on time.
14. Access to information and service termination
The Client may request from Weblabor, in writing and being current, access to the database and files of its system, or a copy of them, during the service and when it ends. The costs of that work are those of the quote. The source code and its delivery are governed by Weblabor's General Terms and Conditions for Software Development Services.
Weblabor does not promise assisted migration to another provider, which is quoted separately, nor does it guarantee preservation of information after the service is terminated. Therefore, it is advisable to request a copy before the payment period in section 13 expires.
15. Cancellation
The Client may stop renewing at any time. Payments for an already started period will not be refunded for that sole reason, except as established in the quote or by law, without prejudice to the rights that the law does not allow to exclude.
16. Limitation of Liability
To the extent permitted by law, Weblabor is not responsible for loss of information, income, or business due to interruptions, provider failures, attacks, lack of customer backups, or expiration of non-renewed services. This does not exclude what the law does not permit to be excluded, such as fraud or non-waivable consumer rights.
17. Personal data
Weblabor treats the Customer's personal data in accordance with its Privacy Notice, published on the "Legal" page of weblabor.mx. Regarding the data of the Customer's system users that are hosted on the hosting, the Customer is responsible and Weblabor stores them on its behalf to provide the service.
18. Acceptance, Notices and Applicable Law
The Client accepts these conditions upon hiring or paying for the service, or upon accepting a quote that mentions them.
Weblabor's notices to the Client are sent to the Client's registered email or through the official support channel. Client notices to Weblabor are sent through Weblabor's official support channels or to the service provider's address indicated above.
Weblabor may update these conditions. Changes are published on this page with their "Last updated" date and are notified to the Client's registered email with at least five business days' notice before they take effect. They do not affect what has already been paid or services already contracted in progress, unless the Client accepts them.
These conditions are governed by the laws of Mexico. For their interpretation and compliance, the parties submit to the competent courts of Mérida, Yucatán, except where the law grants the Client another jurisdiction that cannot be waived.
